Registration Act Wise Table

Registration Status. As can be discerned from Table 2A 37% organisations have a legal entity under any one of the five existing government regulations for registration. The unregistered organisations (63%) also include NGOs that have applied for registration and their cases are under processing. They also include organizations that have as yet not opted for applying for registration.

Table 3A shows that out of the 636 registered organizations, 588 organization i.e. 92% are registered under the Voluntary Social Welfare Agencies Registration and Control Ordinance, 1961. Only 48 NGOs are registered under the remaining three Registration laws, with only 2 opting for the Trust Act, 1882. It may be pertinent to mention have that the various registration laws call for particular legal formalities and obligations including aspects like " what an organization can do," " what will be its organizational structure," etc,. Table 3A is thus indicative of the preference by NGOs of the Voluntary Social Welfare Agencies Ordinance 1961 for most of their programmes/activities and organizational structure. In all the districts, the Department of Social Welfare is authorized for registration of NGOs under the Social Welfare Agencies Ordinance 1961 while the Department of Industries registers NGOs opting for the Societies Act of 1860.

It is interesting to note from the activities and objectives of NGOs that in actual practice many NGOs that fall under the category of the Social Welfare Ordinance have in fact been registered under the Societies Registration Act. The Societies Registration Act, in its essential charter, promotes organisations dealing with religious and political education, awareness raising, sports activities and the like. The Voluntary Social Welfare Agencies Ordinance in its legal context is designed to register NGOs working as voluntary agencies and are engaged in welfare work with poor communities, destitute women and children, prisoners, etc.

The above situation is clearly indicative of the fact that registration laws clearly lag behind actual ground realities.

The district with the highest proportion of registered NGOs is Chitral, Lakki Marwat and with the lowest percent is Hangu and Batagram. Kohistan has only one NGO in the entire district and that too is unregistered.
